How Long Does Probate Take?

Return to FAQ Videos

Transcript:

Probate can take a minimum of seven months once an executor is appointed, and that’s to protect the interest of creditors, and it can take actually years long depending on the assets. Occasionally real estate doesn’t sell right away, or there’s a business involved and there’s more complication.

If we have an estate tax return to do, sometimes the IRS will take several months to process that return. There can even be an audit. These days, less and less estates have a federal estate tax return due because we have a high exemption amount of over five million dollars, so not everybody has to file an estate tax return. I think this results in the IRS being able to audit more returns because simply there are less returns to look at.
