Surrogate Court Practice Lawyer

The Surrogate’s Courts in New York handle all cases involving the affairs of decedents (those who have passed away), including the probate of wills and administration of estates. The surrogate court practice lawyer at Rusk, Wadlin, Heppner & Martuscello, LLP have over 140 years of experience appearing before the surrogate’s courts in Ulster, Orange and Dutchess counties. We handle surrogate court matters in the Mid-Hudson Valley with skill and efficiency, helping to see that the wishes of the decedents are realized while protecting the rights and interests of our clients.

Surrogate’s Court is where the executor files the will to open probate. The Surrogate Court judge admits the will to probate, officially appoints the executor, and issues Letters Testamentary giving the executor power to execute his or her official duties. The final accounting of the probate is filed in Surrogate’s Court. If there is no will to probate, the Surrogate’s Court will administer the estate according to the New York laws of intestate succession.

The estate administration attorneys at Rusk, Wadlin, Heppner & Martuscello, LLP have been appearing in Hudson Valley surrogate courts for more than 140 years.
