Surrogate Court Practice Lawyer

The Surrogate Court judge admits the will to probate, officially appoints the executor, and issues Letters Testamentary giving the executor power to execute his or her official duties. The final accounting of the probate is filed in Surrogate’s Court. If there is no will to probate, the Surrogate’s Court will administer the estate according to the New York laws of intestate succession.
