New York Amputation Injury Lawyer

Losing a limb, or even a finger or toe, can be a severe and life-altering consequence of an accident.  Whether the limb was severed at the time of the accident or needed to be removed later for medical reasons, a person who suffers amputation is likely to face ongoing physical, mental, emotional, and financial challenges for years to come.  If an amputation is caused by someone else’s negligence, then that negligent party must be held liable for the irreparable damage they have brought about.

If you or a loved one has lost a limb to an accident anywhere in the Hudson Valley area, including Goshen, Marlboro and Ulster, contact a zealous personal injury attorney at Rusk, Wadlin, Heppner & Martuscello, LLP, for a consultation with one of our attorneys.  We have years of experience recovering damages for seriously injured accident victims against all types of parties, whether they are negligent drivers, product manufacturers, property owners, or insurance providers.  We will not rest until you get the compensation you and your family deserve for your injuries, your pain and suffering, your medical expenses, and other legal damages.

What is an Amputation Injury?

Amputation refers to when a body part is detached from the body, either partially or totally.  When a person suffers an accident such as a car crash or when a defective product explodes, they could lose an arm, leg, finger, toe, ear, or other body part.  Sometimes, it is possible for those limbs to be reattached immediately and for the injured party to suffer only limited functional loss.  In many cases, however, the limb cannot be reattached and the injured party will be forced to live their life one arm, leg, hand, or foot short.

Amputation can be partial, rather than full.  A partial amputation occurs when some of the soft tissue connecting a body part remains after an accident.  When a limb is partially severed, it may be re-attachable to the body.  Much of the time, however, a partially severed limb poses a severe danger to the injured party and must be surgically removed.  Regardless of whether the loss of limb is partial or total, amputations carry a high risk of serious complications, including excessive blood loss, infection, permanent nerve damage, and shock.

The Effects of Amputation

Victims of amputation, whether partial or full, often suffer a number of side effects and complications for months or years after the initial injury, sometimes permanently.  Amputees often have poor circulation to the affected area of the body, may suffer chronic pain in the remaining portion of the limb, and face the risk of infections, sores, and cysts at the site.  Victims typically require ongoing treatment for pain management, as well as physical therapy to regain functionality absent the limb and with medical prosthetics.  Victims may need continuing care to perform daily functions such as walking, bathing, dressing, eating, exercising, or performing household chores.

Amputation also carries mental and emotional side effects.  Amputees often benefit from counseling to deal with the psychological trauma of losing a limb and the reality of living without that limb permanently, with all the attendant lifestyle changes.  A compassionate personal injury lawyer will help ensure that the negligent party that caused your injury is forced to cover your medical expenses, both past and future, as well as repay you for the pain, suffering, disfigurement, and mental anguish that amputation may cause.
