In New York State, if you slip and fall on someone else’s property can you sue? The answer is yes you can. In New York State, everyone must keep their premises in a reasonably safe condition, and when I have a client come to me and ask me if I’d like to represent them, I always ask them first of all, well tell me what was the defect. Why did you fall, and many times the client may say “Well Dan, I really don’t know,” and then of course I have to learn exactly what was the nature of the fall, what caused the person to take this fall and many times I have to turn the case down, so that’s important factor of course. Just because you fell it’s not good enough.
